How do I claim on business insurance in Kenya?

To claim business insurance in Kenya, make the premises safe, report theft or injury to the police within 24 hours and notify your insurer or agent straight away. Complete the claim form, attach photos, invoices and the police abstract, and let the loss adjuster inspect. Kenya's benchmark for settling claims is about 90 days; small, fully documented claims are often faster.

The claims process, step by step

  1. First 24 hours: make safe and report Protect people and stop further damage. Report break-ins, theft and injuries to the police and note the OB number. Photograph everything before you clean up.
  2. Notify the insurer or your agent Call, email or use the insurer's portal the same day; some insurers ask for notice within 24 hours. Do not admit liability or promise payment to anyone.
  3. Collect the documents Fill in the insurer's claim form for that class and gather the documents listed below. Keep damaged items until the adjuster has seen them.
  4. Meet the loss adjuster For larger losses the insurer appoints an IRA-licensed loss adjuster to inspect, check your records and agree the amount. You can appoint your own loss assessor for a complex claim.
  5. Agree and sign the discharge voucher The insurer offers a settlement, less any excess. Check it against your loss before signing the discharge voucher.
  6. Receive payment or repair Payment is made by cheque or transfer, or the insurer arranges repair or replacement.

How long claims take

Timelines run from when the insurer has every document it needs, so a complete claim is a faster claim.

  2. Published settlement promises vary: one insurer processes claims of up to KES 300,000 within three working days of receiving all documents, while others quote an average of about seven working days for documented general claims.

  3. An employer must report a work accident to the Director of Occupational Safety and Health Services within seven days of learning of it, on form DOSH 1 (WIBA s.22(1)). Fatal accidents must reach the Director within 24 hours (WIBA s.21; OSHA s.21).

  4. A WIBA compensation claim must be lodged within 12 months of the accident or of the employee's death (s.26(1)). Once the Director lodges it, the employer or insurer must settle within 90 days (s.26(4)); failing to pay is an offence carrying a fine of up to KES 500,000, up to a year's imprisonment, or both (s.26(6)).

Why claims are reduced or declined

  • Under-insurance: insure KES 10 million of property for KES 5 million and a KES 2 million loss pays about KES 1 million
  • Theft with no forcible and violent entry or exit, or theft by your own staff under a burglary policy
  • Riot, strike or political-violence damage when that extension was not bought
  • Late notification to the police or the insurer, or lost evidence
  • Non-disclosure: wrong or missing answers on the proposal form, such as an earlier loss or a change of use
  • A broken warranty: no guard on duty, alarm switched off, cash above the safe limit
  • Losses the policy excludes, such as wear and tear or gradual deterioration
  • Missing records: no stock book or invoices to prove what was lost

If you disagree with the insurer

  1. Ask for the decision in writing Request the reasons and the policy clause the insurer relies on.
  2. Use the insurer's complaints procedure Send your evidence and ask for a review. Your agent can help prepare it.
  3. Complain to the regulator If the insurer does not resolve it, complain to the Insurance Regulatory Authority's consumer protection team.
  4. Follow the policy's dispute clause Most policies provide for negotiation, then mediation and arbitration, before court.

Frequently asked questions

What should I do first after a business loss?

Make people and the premises safe, then limit further damage. Report theft, break-ins and accidents involving injury to the police immediately and get the OB number and an abstract. Notify your insurer or agent the same day (some insurers ask for notice within 24 hours). Photograph everything, keep damaged items for the loss adjuster, do not admit liability to anyone, and start listing what was lost with its value.

What documents do I need for a fire claim?

Usually: the completed claim form, photos of the damage, an itemised list of what was lost or damaged with make, age and value, purchase invoices or replacement quotations, repair estimates for items that can be fixed, your stock records and books of account, and any fire brigade or police report. The loss adjuster's report forms part of the claim. Keep damaged items until the adjuster has seen them.

What documents do I need for a burglary claim?

You need the claim form, a police abstract (report within 24 hours), photos showing the forced entry, a list of stolen items with invoices or replacement quotations, stock and sales records from before the loss, and a statement from your guard, watchman, alarm company or witnesses. Burglary cover pays only where entry or exit was forcible and violent; theft by your own staff needs fidelity guarantee cover.

How long does a business insurance claim take in Kenya?

Kenya's claims benchmark is about 90 days. Some insurers publish faster targets once all documents are in: one processes claims of up to KES 300,000 within three working days, and others quote about seven working days on average for documented general claims. Large or disputed losses take longer because a loss adjuster must investigate. Draft IRA guidelines would tighten the timelines.

Why are business insurance claims declined or reduced?

The common reasons are under-insurance (the average clause cuts the claim in proportion), theft without forcible and violent entry, riot or political-violence damage when that extension was not bought, late notification, wrong or missing information on the proposal form, breaking a security warranty, and losses the policy excludes. Most can be avoided by insuring at true values and reading the warranties.

What is the average clause in business insurance?

Most property policies carry an 'average' condition: if you insure for less than the true value, the insurer cuts your claim in proportion. Insure a property worth KES 10 million for KES 5 million and a KES 2 million loss pays about KES 1 million. Review your sums insured at every renewal, especially stock that rises during busy seasons.

How do I complain if my insurer will not pay a claim?

Ask the insurer for its decision in writing with reasons, then use its internal complaints procedure. If that does not resolve it, complain to the Insurance Regulatory Authority's consumer protection team. Your policy will also have a dispute clause, usually negotiation, then mediation and arbitration, and you can go to court. Your agent can help you put the case together.

What happens if my insurer collapses?

If an insurer collapses, the Policyholders Compensation Fund compensates eligible claimants up to KES 500,000 each, which may be far less than a large business claim. In March 2026 Trident and Corporate Insurance were placed under statutory management and cannot write new business. Before you buy, check that the insurer is licensed and active, and spread very large risks if needed.
