Is public liability insurance required in Kenya?
Public liability insurance in Kenya pays compensation and legal costs when a customer, visitor or member of the public is injured, or their property damaged, because of your business. No general law requires it, but landlords, malls, event venues and tender buyers often do. Small shops and offices typically pay about KES 10,000–30,000 a year for a KES 5 million limit, before levies.
What it covers
Injury to the public
Bodily injury, illness or death of customers, visitors, passers-by and others who are not your employees, where your business is legally liable.
Damage to their property
Accidental loss of or damage to other people's property, such as a client's premises while you work there or a neighbour's shop after a leak.
Legal defence costs
The cost of defending a claim, where the insurer agrees in writing first. Some wordings pay costs in addition to the limit; others inside it.
On and off your premises
Incidents at your premises and, where declared, at clients' sites and events within the territory in your policy.
Optional extensions
Products liability, hotel guests' belongings, car-park liability and fire or explosion spreading to neighbours, depending on the insurer.
What is not covered
- Injury to your own employees (this is WIBA and employers' liability)
- Injury or damage caused by products after they leave your hands, unless products liability is added
- Financial loss from your advice, design or professional services (this is professional indemnity)
- Liability you accept under a contract that you would not otherwise have
- Damage to property you own or that is in your care, custody or control
- The cost of putting right your own defective work
- Accidents involving motor vehicles (your motor policy responds)
- Pollution, war, riot and nuclear risks, and deliberate acts
What the rules say
No Kenyan law we reviewed requires businesses in general to carry public liability or fire insurance. The Occupational Safety and Health Act sets fire-safety duties (fire-fighting equipment, trained staff, escape routes) but no insurance duty, and the parts of the National Building Code 2024 we reviewed contain none. Landlords, lenders, malls and tender buyers often require it by contract.

Employers' liability is usually priced at about 25%–40% of the WIBA premium. Many businesses need more than one of these covers.
Products liability
What it pays
Compensation and legal costs for death, injury, illness or property damage caused by goods you make, assemble, label, import, sell, supply or repair.
How it is sold
As an extension to public liability or a separate policy. The IRA publishes a standard products' liability wording.
Food and drink
Food producers and exporters can also ask about contaminated product cover, which one insurer offers for recall and tampering costs.
Choosing your limit
- Start with the limit in your lease, mall rules, event contract or tender, and ask for that wording before you buy.
- Check whether the limit applies to any one occurrence, to the whole year, or both.
- Ask whether legal defence costs sit inside the limit or are paid on top.
- One SME package sets a minimum limit of KES 1 million; another offers up to KES 20 million any one event.
- Manufacturers, contractors and businesses with large footfall usually need KES 20 million or more.
What public liability costs
| Business | Typical limit | Typical premium |
|---|---|---|
| Small shop or office | KES 5 million | about 10,000 – 30,000 |
| Restaurant, salon, clinic | KES 5 – 10 million | about 15,000 – 50,000 |
| Manufacturer or contractor | KES 20 – 100 million+ | about 50,000 – 150,000+ |

Your trade drives the price more than your size: a busy restaurant pays more than an office of the same turnover.
How to get a public liability certificate
- Tell us the requirement Share the limit and any wording your landlord, mall, client or event organiser needs, such as naming them as an interested party.
- Compare quotes We send you options from several insurers with the limit basis, excess and key exclusions.
- Pay and receive Pay by M-Pesa, bank transfer or card. The insurer issues the policy schedule and a certificate you can forward.
Directors and officers liability
What D&O covers
Directors' and officers' personal liability and defence costs for claims alleging wrongful acts in running the company, where the company does not indemnify them.
Who offers it
Several insurers offer D&O. It is usually quoted individually rather than bundled into SME packages, though one school package includes it for boards.

Frequently asked questions
What is public liability insurance?
Public liability insurance pays compensation and legal costs if your business is legally liable for injury to, or the death of, a customer, visitor or other member of the public, or for damage to their property. Claims usually arise from slips, falls, falling objects or work done at a client's site. It does not cover your own employees, which is WIBA and employers' liability.
Is public liability insurance mandatory in Kenya?
No Kenyan law we reviewed requires businesses in general to carry public liability insurance. In practice it is often a contract condition: landlords, shopping malls, event venues, lenders and tender buyers regularly ask for a certificate and a minimum limit before you can move in, trade or sign.
What is the difference between public liability, products liability and professional indemnity?
Public liability covers injury or property damage caused by your premises or activities. Products liability covers injury or damage caused by goods you make, import, sell or repair after they leave your hands. Professional indemnity covers financial loss caused by your advice, design or professional mistakes. A manufacturer may need the first two; a consultant mainly needs the third.
How much public liability cover does my business need?
Start with any limit your landlord, mall, client or tender sets, then consider your worst realistic claim. Small shops and offices commonly carry about KES 5 million, restaurants, salons and clinics KES 5–10 million, and manufacturers or contractors KES 20 million or more. Check whether the limit is per occurrence or for the whole year, and whether legal costs are inside it.
Do I need employers' liability as well as WIBA?
WIBA pays the fixed compensation in the Act. Employers' liability (common-law) cover pays damages and legal costs when an employee sues you for negligence or breach of a safety duty. It is not required by law, but higher-risk employers often buy it. Some insurers sell it only alongside WIBA, typically at about 25%–40% of the WIBA premium.
Which business insurance is compulsory in Kenya?
Three covers are required by law for the businesses they apply to: WIBA for every employer, with no small-employer exemption; third-party motor cover for every vehicle on the road, including passengers for PSVs; and marine cargo cover with a Kenyan-licensed insurer for imports. Certain professions, such as doctors and advocates, must also hold professional indemnity. Fire and public liability are not required by general law, but landlords, lenders and tenders often insist on them.
Does business insurance cover food poisoning claims?
Usually only if you arrange it. Food poisoning claims fall under products or 'food and drink' liability, which is an extension to public liability or a separate products liability policy. A basic public liability policy may not cover illness caused by food you serve or sell. Check the wording names food and drink, and that the limit suits the number of guests you serve.
What levies are added to business insurance premiums?
Three statutory charges are added to the premium: a training levy of 0.2%, a Policyholders' Compensation Fund levy of 0.25% and stamp duty of KES 40. On a KES 50,000 premium, that adds about KES 265. Check that your quote shows them as separate lines so you can compare insurers on the same basis.
What should I do first after a business loss?
Make people and the premises safe, then limit further damage. Report theft, break-ins and accidents involving injury to the police immediately and get the OB number and an abstract. Notify your insurer or agent the same day (some insurers ask for notice within 24 hours). Photograph everything, keep damaged items for the loss adjuster, do not admit liability to anyone, and start listing what was lost with its value.
What documents do I need to buy business insurance?
Expect to provide a completed proposal form, your KRA PIN, a certificate of registration or incorporation, a CR12 for limited companies, and the ID or passport of the person signing (some covers, such as bonds, ask for every director's ID). The insurer will also want a list of what you are insuring and its value, staff numbers and annual earnings for WIBA, your premises' construction and security, and three years' claims history.
