Is WIBA insurance mandatory in Kenya?
Yes. WIBA insurance is compulsory for every employer in Kenya under section 7(1) of the Work Injury Benefits Act 2007, with no exemption for small employers, and it covers casual workers in your business. Failing to insure can mean a fine of up to KES 100,000, up to three months in jail, or both. Premiums typically run about 0.5%–2% of annual payroll.
What WIBA covers
WIBA is no-fault cover: the insurer pays the compensation the Act sets, whether or not anyone was to blame.
Time off work
Earnings for an employee off work for three days or more, for up to 12 months.
Permanent disablement
A lump sum based on 96 months' earnings multiplied by the degree of disablement in the Act's First Schedule.
Death
Compensation to dependants under the Act's formula, plus funeral expenses up to a set maximum.
Medical costs
Reasonable medical expenses for the injury or occupational disease.
Occupational diseases
Illness caused by the work itself, not only sudden accidents.
All employees in the business
Permanent, contract and casual staff engaged for your trade or business.
What WIBA does not cover
- Injuries outside work (unless you add GPA or buy WIBA Plus)
- Negligence lawsuits by employees above the WIBA amounts (employers' liability covers these)
- Owners and directors not employed under a contract of service
- Casuals hired for a purpose unrelated to your business
- Common policy exclusions such as war and terrorism, self-inflicted injury, and some named industrial lung diseases
Exclusions differ between insurers; we point them out when we compare quotes.
What the law says
These are the WIBA rules that matter most to employers. Each is taken from the Act or a court decision.
Every employer in Kenya must insure against its liability to employees for work injuries and occupational diseases (Work Injury Benefits Act, 2007, s.7(1)). There is no exemption for small employers.
An employer who fails to insure commits an offence: on conviction, a fine of up to KES 100,000, up to three months' imprisonment, or both, plus up to KES 10,000 for every day the breach continues after conviction (WIBA s.7(4)–(5)).
WIBA covers casual workers engaged for the purpose of the employer's trade or business; only casuals employed for some other purpose are excluded (s.5(3)(a)).
An employer must report a work accident to the Director of Occupational Safety and Health Services within seven days of learning of it, on form DOSH 1 (WIBA s.22(1)). Fatal accidents must reach the Director within 24 hours (WIBA s.21; OSHA s.21).

A WIBA compensation claim must be lodged within 12 months of the accident or of the employee's death (s.26(1)). Once the Director lodges it, the employer or insurer must settle within 90 days (s.26(4)); failing to pay is an offence carrying a fine of up to KES 500,000, up to a year's imprisonment, or both (s.26(6)).
In January 2026 the Employment and Labour Relations Court held that an unpaid DOSHS compensation award can be adopted and enforced as a court judgment.
Kenya's Labour Cabinet Secretary reported 390 workplace deaths out of 7,731 occupational accidents in the year to May 2024.

How your WIBA premium is calculated
Insurers price WIBA on payroll, not headcount:
- List staff by occupation group (office, sales, drivers, machine operators, security and so on).
- Estimate each group's earnings for the coming year: basic pay, cost-of-living allowance, the value of food or housing provided and regular overtime.
- Multiply each group's earnings by its occupation rate, typically about 0.5% for office staff up to 2% or more for high-risk work.
- Add the groups together; a minimum premium of about KES 10,000–15,000 applies.
- At year end, declare actual wages; the premium is adjusted up or down.
Example: 10 office staff on a combined KES 4.8 million a year pay about KES 24,000–33,600 a year before levies. Try the WIBA cost calculator for your own figures.

How to make a WIBA claim
- Treat and record Get the employee medical care, then write down what happened, when, where and who saw it.
- Report to DOSHS Send form DOSH 1 to the county Directorate of Occupational Safety and Health Services within seven days of learning of the accident; a fatal accident must reach the Director within 24 hours.
- Tell your insurer Notify the insurer straight away and send a copy of the DOSH 1.
- Gather documents Medical reports and original receipts, sick-off sheets, the appointment letter or payslips, the employee's ID copy, witness statements and an incident or safety committee report; a police abstract for road accidents.
- DOSHS assesses An officer may investigate and arrange a medical assessment, then the Director assesses the compensation and lodges the claim.
- Payment The claim must be lodged within 12 months of the accident; once the Director lodges it, the employer or insurer must pay within 90 days.

Frequently asked questions
What is WIBA insurance?
WIBA insurance covers an employer's legal duty to compensate employees who are injured, disabled or killed at work, or who catch an occupational disease, under the Work Injury Benefits Act 2007. The insurer pays what the Act requires: earnings while the employee is off work, a lump sum for permanent disablement or death, reasonable medical costs and funeral expenses. It is compulsory for every employer in Kenya.
Is WIBA insurance mandatory in Kenya?
Yes. Section 7(1) of the Work Injury Benefits Act requires every employer in Kenya to insure its liability to employees for work injuries and occupational diseases. There is no exemption for small employers, so a business with one employee needs cover, and casual workers engaged for your business count. Not insuring is a criminal offence.
What is the penalty for not having WIBA insurance?
An employer who fails to insure commits an offence. On conviction the fine is up to KES 100,000, up to three months' imprisonment, or both, plus up to KES 10,000 for every day the breach continues after conviction. You still owe the injured employee their compensation, in January 2026 the Employment and Labour Relations Court held that an unpaid DOSHS award can be enforced as a judgment.
Does WIBA cover casual workers?
Yes. WIBA covers casual workers engaged for the purpose of your trade or business. Only a casual hired for some other purpose, such as a one-off job unrelated to the business, falls outside the Act. Declare casuals' expected wages when you buy cover; leaving them out of the payroll is a common reason for a claim to be disputed or the premium to be adjusted later.
What does WIBA pay an injured employee?
WIBA pays earnings for an employee off work for three days or more, for up to 12 months; a lump sum for permanent disablement worked out from 96 months' earnings multiplied by the degree of disablement in the Act's First Schedule; reasonable medical costs; and funeral expenses up to a set maximum. Death benefits also follow the Act's formula.
What is the difference between WIBA and GPA?
WIBA is compulsory and pays only the compensation the Work Injury Benefits Act sets for injuries and diseases arising from work. Group personal accident (GPA) is optional: it pays agreed benefits for accidental death, disablement and medical costs 24 hours a day, on or off duty. GPA is typically priced at about 25%–40% of the WIBA premium when added to it.
What is WIBA Plus?
WIBA Plus is the market name for WIBA combined with group personal accident cover in one policy. The WIBA part meets your legal duty for work injuries; the GPA part extends protection to accidents outside working hours, so staff are covered 24 hours a day. Insurers usually price the extension as a loading on the WIBA premium.
Do I need employers' liability as well as WIBA?
WIBA pays the fixed compensation in the Act. Employers' liability (common-law) cover pays damages and legal costs when an employee sues you for negligence or breach of a safety duty. It is not required by law, but higher-risk employers often buy it. Some insurers sell it only alongside WIBA, typically at about 25%–40% of the WIBA premium.
Does WIBA cover company directors and owners?
WIBA covers employees working under a contract of service for wages or a salary. A sole proprietor, partner or director who is not employed on such a contract generally falls outside the Act, so their own injuries would not be paid under WIBA. Owners and non-employed directors usually add themselves to a group personal accident policy instead. Ask your insurer how your directors are treated.
How do I make a WIBA claim?
Get the employee treated, then report the accident to the county DOSHS office on form DOSH 1 within seven days, or within 24 hours if it is fatal. Notify your insurer at the same time. Collect medical reports, receipts, sick-off sheets, payslips and witness statements. The claim must be lodged within 12 months; once DOSHS lodges it, payment is due within 90 days.
