Hospital & Clinic Malpractice Insurance in Kenya

Facility-level cover for the professional liability of your clinical team, as the law requires, structured around your services and staff.

We compare 9+ of Kenya's top insurers so you get the best cover at the lowest price.

Does a hospital or clinic need its own malpractice cover?

Yes. The Medical Practitioners and Dentists Act requires every health institution in Kenya to insure each year against the professional liability of its staff, separately from each doctor's own professional indemnity. Facility policies cover patient injury caused by negligence of the institution's clinical team, with any-one-claim and annual aggregate limits.

The legal requirement

  1. Doctors and dentists must hold professional indemnity cover every year, and every health institution must insure against the professional liability of its staff (Medical Practitioners and Dentists Act, s.15A). KMPDC will not renew a practising licence without valid PI. The law sets no minimum limit.

Frequently asked questions

Does a hospital or clinic need its own malpractice cover?

Yes. The Medical Practitioners and Dentists Act requires every health institution to insure each year against the professional liability of its staff. This is separate from each practitioner's own PI.

Does the facility policy cover our doctors, nurses and visiting consultants?

It depends on the wording. Facility policies cover the institution's liability for its staff, but cover for visiting or independent consultants varies. Declare every category of clinician who works at the facility and confirm in writing which ones are covered.

What do hospital malpractice policies usually exclude?

Typical exclusions include cosmetic surgery (unless reconstructive), fertility and IVF treatment, HIV/hepatitis-related claims, blood-bank activities, genetic manipulation, services beyond the facility's licensed scope, and intoxication. Some of these can be negotiated, so tell us what your facility does.

What does 'claims-made' mean?

Kenyan PI policies respond to claims made against you while the policy is in force, not when the mistake happened. So if you stop renewing, a claim that arrives later about past work is not covered, unless you have run-off cover. Keep your cover continuous.

How much cover (limit) do I need?

At least any legal minimum for your profession, then enough to meet the largest claim you could realistically face: think of your biggest contract or fee, what a client could lose through your error, and any limit a client or tender requires. Remember that defence costs usually come out of the same limit.
