How to Make a Professional Indemnity Claim

What to do, and what not to do, from the first complaint to settlement.

We compare 9+ of Kenya's top insurers so you get the best cover at the lowest price.

The short answer

If you receive a complaint, demand letter or summons, do not admit liability, apologise in writing, offer payment or reply to the claimant. Record what happened, keep every document, and notify your insurer in writing straight away, forwarding the letter unanswered. Do not appoint lawyers or incur costs until the insurer agrees.

Step by step

  1. Record the incident immediately: dates, people, what was said and done.
  2. Do not admit liability, make offers or correspond with the claimant.
  3. Notify your insurer (or Naveah) in writing by email or letter, attaching the demand or summons unanswered.
  4. Complete the claim form and provide your files, contracts and records.
  5. Agree with the insurer before appointing lawyers or incurring costs.
  6. Cooperate with the insurer's defence and approve any settlement.

Documents the insurer will ask for

  • Completed claim form
  • Claimant's name, address and occupation
  • The demand letter or summons, and the date you received it
  • What is alleged, and your account of the facts
  • Relevant files, contracts, records and correspondence

Why reporting early matters

Key factChecked against its source · 5 Oct 2026· checked 5 Oct 2026
  1. Every Kenyan insurer that states a basis writes PI on a claims-made basis: the policy that responds is the one in force when the claim is made, not when the mistake happened.

Report any incident or circumstance that could lead to a claim as soon as you know of it: once reported during the policy period, a later claim is covered even after renewal.

Frequently asked questions

What should I do if I receive a demand letter or court summons?

Do not admit liability, apologise in writing, offer payment or reply to the claimant. Note what happened, keep all records, and notify your insurer (or us) in writing immediately, forwarding the letter unanswered. Do not appoint lawyers or incur costs before the insurer agrees.

Do I need to report a problem before a claim is made?

Yes. Policies require prompt written notice of any incident or circumstance that could lead to a claim. Reporting it during the policy period protects you even if the claim arrives after renewal; failing to report it can mean the claim is excluded later.

What information does the insurer need for a PI claim?

The completed claim form; the claimant's name, address and occupation; the date and copy of the demand or summons; what is alleged; your account of the facts; and relevant files, contracts, records and correspondence.

What does 'claims-made' mean?

Kenyan PI policies respond to claims made against you while the policy is in force, not when the mistake happened. So if you stop renewing, a claim that arrives later about past work is not covered, unless you have run-off cover. Keep your cover continuous.

What happens to my cover when I retire or close my practice?

Because PI is claims-made, you need run-off cover to stay protected against claims about work you did before you stopped. Insurers offer it on request; ask us to price it before you close or retire.
