Is international life insurance legal in Kenya?

Yes, when it is arranged the way the Insurance Act requires. Insurance on someone living in Kenya with an insurer outside Kenya needs the Commissioner of Insurance's prior written approval, and a policy is not void just because that step was missed. A Kenyan living abroad and paying from abroad appears to fall outside the rule. We explain how your cover is arranged before you apply.

What the Insurance Act says

  2. Placing Kenyan insurance with an insurer that is not licensed in Kenya needs the Commissioner of Insurance's prior written approval. Breaking the rule is an offence (a fine of up to KES 5 million, up to 5 years in prison, or both), though the policy itself stays valid.

  3. A Kenyan living abroad who pays premiums from abroad appears to fall outside 'Kenya business'. This is a reading of the Act's wording, not yet confirmed by the IRA.

  2. Health details are sensitive personal data. Sending them to an insurer outside Kenya needs your consent and proper safeguards.

  3. The relief applies to a policy with an insurer lawfully carrying on life business in Kenya, with the sum assured payable in Kenya in Kenyan shillings, so a foreign-currency policy is unlikely to qualify.

Frequently asked questions

Is international life insurance legal in Kenya?

Insurance on someone living in Kenya with an insurer outside Kenya needs the Commissioner of Insurance's written approval under the Insurance Act; a policy is not void just because that step was missed. We explain how your cover is arranged before you apply.

Does the approval rule apply if I live abroad?

It appears not. The rule covers 'Kenya business': insurance on a life situated in Kenya or paid for from Kenya. A Kenyan living abroad and paying from abroad appears to fall outside it, though the IRA has not confirmed this.

Does the rule apply to expatriates living in Kenya?

Yes. The test is where the insured person lives, not their nationality, so cover on an expatriate living in Kenya is 'Kenya business'.

Is my policy valid if the rule was not followed?

Yes. The Act says a policy is not invalid, void or unenforceable just because it was placed without approval; the offence falls on whoever placed it. Your family's claim stands.

How do I check an international insurer?

Ask for the insurer's full name, its regulator and licence, its financial strength rating, which protection scheme covers you, and how claims are paid to Kenya. We give you all of this in writing with your quote.

Do I lose anything by choosing international cover?

Three things: the 15% insurance relief (it needs a shilling policy payable in Kenya), the Policyholders Compensation Fund (it covers Kenyan insurers only) and the IRA complaints route. Your protection then comes from the insurer's home-country rules, which can be stronger for large sums.
