Do engineers and architects need professional indemnity in Kenya?
It is not required by EBK's Engineers Rules 2019, but most consultancy contracts and tenders ask for it. For architects and quantity surveyors, the BORAQS conditions of engagement cap your liability at the PI sum agreed with the client, so the limit you hold sets your exposure. Premiums are rated on fee income and contract size.
What the rules say
The Engineers Rules 2019 contain no PI requirement for registered engineers, but clients and tenders often ask for it.

Under the BORAQS conditions of engagement (LN 188/2023), an architect's or quantity surveyor's liability is limited to the PI sum agreed with the client, so the limit you buy effectively caps what you can be held to.

Many government bodies and contractors make PI a minimum requirement to bid for consultancy tenders, and some employers ask for it too.

Frequently asked questions
Do engineers and architects need PI by law?
Not under EBK's Engineers Rules 2019. For architects and quantity surveyors, the BORAQS conditions of engagement cap your liability at the PI sum agreed with the client. In practice, most consultancy contracts and tenders ask for PI, and the limit you hold can decide whether you can bid.
Can I buy PI for a single project?
No Kenyan insurer publishes single-project PI. Projects are usually covered under your annual practice policy, with the limit set to suit your largest contract. Tell us if a client needs a project-specific limit or certificate.
How much cover (limit) do I need?
At least any legal minimum for your profession, then enough to meet the largest claim you could realistically face: think of your biggest contract or fee, what a client could lose through your error, and any limit a client or tender requires. Remember that defence costs usually come out of the same limit.
Are my employees and partners covered?
Yes. Firm policies cover mistakes by partners and employees acting in their professional roles, and some also cover people working under your supervision. Tell the insurer about partners joining or leaving: incoming and outgoing partner extensions are available.
What happens to my cover when I retire or close my practice?
Because PI is claims-made, you need run-off cover to stay protected against claims about work you did before you stopped. Insurers offer it on request; ask us to price it before you close or retire.
Bidding for a contract?
Send us the tender's PI requirement and deadline. We will quote to match it.
